B2B debt collection in India works best when the collector has legal standing. FundRaksha assigns a dedicated advocate who sends a legal notice within 24 hours, negotiates a payment plan, and files under the MSMED Act, Section 138 or a summary suit if the buyer still refuses. About 60% of cases settle before anything is filed. You pay nothing upfront; the fee is 30% of what is recovered.
What a B2B debt collection agency does, and what it should not do
A B2B collection agency recovers money owed by one business to another: unpaid invoices, supply bills, service fees, freight charges and contract payments. The buyer is a company, firm or proprietor, not a consumer. That difference matters. Commercial buyers respond to documented legal pressure, not to phone calls from an unknown recovery agent, and they know when a collector has no power to escalate.
A good agency therefore works in writing, keeps the relationship recoverable where possible, and never resorts to intimidation. Visiting a buyer's premises, calling his customers or posting about him online is unlawful, exposes you to counter-claims and almost never produces payment. FundRaksha works only through advocates and the remedies the law provides.
Why FundRaksha is rated India's best B2B collection agency
- Track record you can check: 1,000+ businesses onboarded, 700+ paid, ₹50 Cr+ in invoice value handled.
- Speed: a dedicated advocate is assigned and the legal notice goes out within 24 hours of receiving your documents, as an e-notice and by registered post.
- Settlement focus: 60% of cases close at the notice and negotiation stage, which means you get paid without a court filing.
- Aligned fee: 30% of the amount recovered, nothing upfront. If nothing is recovered, there is no fee.
- One team to the end: the advocate who sends the notice is the advocate who files on MSME Samadhaan, under Section 138 or in court.
Collection agents who are not advocates have to hand your file to a lawyer the moment the buyer digs in. That hand-off costs weeks. We remove it.
The four-step collection process
- Free consultation and case assessment. Share the invoices, purchase order, delivery proof and the buyer's messages. We tell you what is recoverable, by which route, and roughly how long it will take.
- Legal notice within 24 hours. The notice itemises each invoice, the due dates, the interest claimed and the consequences of non-payment, and is delivered with proof.
- Advocate negotiation. The advocate speaks to the buyer, answers disputes with documents and agrees either full payment or a signed instalment plan with post-dated payments.
- Filing if needed. MSME Samadhaan for Udyam-registered suppliers, a Section 138 complaint for bounced cheques, a summary suit under Order XXXVII CPC on written contracts and invoices, or arbitration where the contract provides for it.
Court fees, where a matter is filed, are borne by the client and are told to you before anything is filed. There are no other charges.
Which legal route fits which debt
| Situation | Route | Key fact |
|---|---|---|
| Udyam-registered micro or small supplier, buyer late beyond 45 days | MSME Samadhaan | Interest at three times the RBI bank rate, compounded monthly; Council target 90 days |
| Buyer paid by cheque, cheque bounced | Section 138, NI Act | Notice within 30 days of return memo; buyer has 15 days to pay; complaint within one month after |
| Written contract or invoices, no genuine dispute | Summary suit, Order XXXVII CPC | Buyer must seek leave to defend; faster than an ordinary suit |
| Contract has an arbitration clause | Arbitration | Award enforceable as a court decree |
Many cases qualify for more than one route. The free assessment picks the fastest one for your facts. See MSME Samadhaan filing, cheque bounce recovery and summary suit recovery for detail.
Act before limitation runs out
The Limitation Act gives three years from the due date to sue on an invoice. A written acknowledgement or a part-payment by the buyer restarts the clock, which is one reason the advocate's first job is to get the buyer to respond in writing. Debts older than three years without any acknowledgement are very hard to recover through the courts, so do not wait for the financial year to close. Use the limitation period calculator to check your dates, or book a free consultation and we will check them for you.
