Legal debt recovery means using the remedies Indian law gives a creditor: a legal notice, the MSMED Act's Facilitation Council, a Section 138 complaint for bounced cheques, a summary suit under Order XXXVII CPC, or arbitration. The five legal remedies, in plain language

Legal notice

Sent within 24 hours as an e-notice and by registered post with proof of delivery. It is a demand and a warning, and it is a precondition for several of the remedies below. See legal notice for payment.

MSME Samadhaan

For Udyam-registered micro and small suppliers. Sections 15 to 18 of the MSMED Act fix payment at 45 days (15 days if nothing is agreed), add compound interest at three times the RBI bank rate, and send disputes to the Micro and Small Enterprises Facilitation Council, which aims to decide in 90 days. A buyer wanting to appeal must deposit 75 percent of the award first.

Section 138, Negotiable Instruments Act

For bounced cheques. Notice within 30 days of the bank return memo, 15 days for the drawer to pay, complaint within one month after that. Conviction can mean up to two years imprisonment or a fine up to twice the cheque amount.

Summary suit

Order XXXVII of the Civil Procedure Code lets a creditor with a written contract, invoice or promissory note sue without a full trial; the buyer must obtain leave to defend. The limitation period is three years.

Arbitration

Where the contract has an arbitration clause, the advocate invokes it, and the award is enforced as a decree.
