Payment ke liye legal notice: isme kya hota hai aur yeh kaam kyun karta hai

Ek achha legal notice sirf "paisa do" nahi bolta. Woh party ke accountant aur management ko dikhata hai ki aapka claim documented hai, interest chal raha hai, aur agla kadam kya hoga. Isi wajah se zyada tar cases notice par hi settle ho jaate hain. Yeh page notice ke andar ki baat samjhata hai.

Short answer

Payment ke legal notice mein dono parties ki details, business relationship, invoices aur amount, due dates, interest ka claim, payment ki deadline (aam taur par 7 se 15 din), aur payment na hone par legal kadam (MSME Samadhaan, Section 138, summary suit) likhe hote hain. FundRaksha mein 60% cases is stage par settle hote hain, aur fee sirf recovery par 30% hai.

Notice ke andar kya hota hai

  1. Parties. Aapka business aur party ka registered naam, address, GSTIN.
  2. Relationship. Kab se business, kaunsa maal ya service, kaunse orders.
  3. Claim. Invoice-wise amount, due dates, partial payments, aur net balance.
  4. Interest. Contract ka rate, ya MSMED Act ka statutory interest.
  5. Deadline. Kitne din mein payment.
  6. Consequences. Payment na hone par kaunsa legal raasta.

Notice kaam kyun karta hai

Party ke liye ab tak aapka payment ek phone call tha jise taala ja sakta tha. Notice ke baad yeh ek legal claim hai jo uske auditors, bank aur management ko dikh sakta hai. Interest ka number har mahine badhta dikh raha hai. Aur agle kadam ka saaf zikr hai. Party ke liye ab payment karna sasta padta hai.

Notice ka tone firm par respectful hona chahiye. Dhamki ya gaali wala notice ulta party ko defence deta hai.

Kharcha aur fee

FundRaksha mein notice ke liye upfront kuch nahi. Fee sirf recover hue amount par 30%. Agar notice ke baad paisa aa gaya, to bas wahi fee. Agar case Samadhaan ya court jaata hai, to court fee (agar lage) client deta hai, aur pehle bata di jaati hai. Calculate kariye: recovery fee calculator.

Notice ke reply ke common bahane

Notice milne par kai parties jawab mein bahane bhejti hain. Inhe pehchaniye:

  • "Maal kharab tha." Delivery ke time koi complaint nahi aur ab achanak? Aapke challan aur messages iska jawab hain.
  • "Rate zyada lagaya." PO ya order message mein rate fix tha.
  • "Hamara aapse koi contract nahi." GST invoice, ITC claim aur payments ka record relationship saabit karta hai.
  • "Hum counter-claim karenge." Aksar sirf dar dikhane ke liye; documents ke bina yeh tikta nahi.

Reply ka jawab advocate deta hai, aapke documents ke saath. Party ka reply bhi record ban jaata hai, aur kai baar usme party kuch amount maan leti hai jo baad mein kaam aata hai.
