MSME 45 din ka niyam: buyer ko kitne din me payment karna zaroori hai

Agar aap Udyam registered micro ya small supplier hain, to kanoon aapke saath hai. MSMED Act kehta hai ki buyer ko 45 din ke andar payment karna hi padega, chahe usne kuch bhi likha ho. MSMED Act ke Section 15 ke hisaab se buyer ko micro ya small supplier ka payment agreed date par karna hai, aur agreement me jo bhi likha ho, ye 45 din se zyada nahi ho sakta. Agar koi written agreement nahi hai to 15 din ki limit lagti hai. Deri hone par buyer ko RBI bank rate ka 3 guna byaj, monthly compound, dena padta hai, aur aap MSME Samadhaan par case file kar sakte hain.

45 din kab se ginte hain?

Ginti maal ya service ke acceptance ki date se shuru hoti hai. Agar buyer ne koi objection nahi diya, to delivery ki date ko hi acceptance maana jaata hai. Matlab aapne 1 tareekh ko maal deliver kiya aur buyer ne 15 din tak koi complaint nahi ki, to payment ki deadline wahi 45 din wali ginti se chalegi.

  • Written agreement hai: jo din likha hai wo, lekin 45 din se zyada nahi.
  • Written agreement nahi hai: acceptance ke 15 din ke andar.
  • Buyer ne "90 din credit" likha hai: kanoon ki nazar me fir bhi limit 45 din hi hai.

Ye niyam sirf un suppliers ke liye hai jo Udyam registration ke saath micro ya small category me aate hain. Medium enterprise ko Samadhaan ka fayda nahi milta, unke liye legal notice aur civil suit ka rasta hai.

Deri hone par aapko kya milta hai

Sabse bada hathiyar hai byaj. Section 16 ke hisaab se buyer ko RBI bank rate ka teen guna byaj dena hota hai, monthly compound. Ye invoice pe likha ho ya na ho, kanoon se milta hai. Purane bill par ye byaj kaafi bada ho jaata hai, isliye buyer jaldi settle karna pasand karta hai.

Buyer ke liye ek aur dard hai: Income-tax s.43B(h). Agar wo time limit ke baad pay karta hai, to us saal wo expense claim nahi kar sakta. Ye baat legal notice me likhne se buyer ka accountant khud payment push karta hai.

Is niyam ko paisa nikalne ke liye kaise use karein

  1. Udyam certificate check karein. Registration supply ke time valid hona chahiye.
  2. Invoice, PO aur delivery proof ek folder me rakhein.
  3. Advocate se legal notice bhejein jisme Section 15 aur 16 ka zikr ho. FundRaksha 24 ghante me notice bhejta hai.

Aam galtiyan jo supplier karte hain

  • Udyam registration supply ke baad karwana: purani supply par Act ka fayda nahi milta.
  • Buyer ke kehne par "byaj maaf" likh dena. Pehle salah lein.
  • Saalon tak wait karna. Limitation Act me 3 saal ki limit hai, uske baad case kamzor ho jaata hai.
