Short answer

Free consultation 20 se 30 minute ki call hai, phone, WhatsApp ya video par. Expert aapke invoice, order, delivery proof aur buyer ke messages dekhta hai, honest batata hai ki case kitna strong hai, aur sahi raasta suggest karta hai: reminder, legal notice, MSME Samadhaan, Section 138, summary suit ya arbitration. Aage badhein to upfront kuch nahi dena; 30% sirf us paise par jo actually recover ho.

Yeh consultation kiske liye hai

Har us business ke liye jiska paisa kisi doosre business ke paas atka hai: manufacturer jiska buyer credit period cross kar gaya, trader jiska cheque bounce hua, service company jiska client reply nahi kar raha, contractor jiska retention release nahi hua. Amount chhota ho ya bada, kanoon aur tareeka same hai, bas raasta badalta hai.

Yeh un logon ke liye bhi hai jo sure nahi hain ki case ladna chahiye ya nahi. Call ki sabse badi value yahi hai ki aapko honestly bataya jaata hai ki case weak hai, time-barred hai, ya sirf ek proper reminder se kaam ho jaayega.

Call mein kya hota hai

  1. Documents. Invoice, purchase order, delivery challan ya e-way bill, aur buyer ke WhatsApp messages dekhe jaate hain. Jo kami hai, woh bataayi jaati hai.
  2. Recoverability. Buyer ne debt maana hai ya dispute kiya? Buyer abhi bhi business kar raha hai? Claim 3 saal ke limitation period ke andar hai?
  3. Raasta. Reminder, advocate ka legal notice, MSME Samadhaan (MSMED Act), Section 138 (cheque bounce), summary suit (Order XXXVII CPC), ya arbitration agar contract mein clause hai.
  4. Timeline aur kharcha. Har stage ka realistic time, aur exact cost: upfront kuch nahi, 30% sirf recovered amount par, court fees agar file hua to pehle bata di jaati hai.

Kanoon aapke saath hai: teen baatein

  • MSMED Act (Section 15-18): Agar aap Udyam-registered micro ya small enterprise hain, to buyer ko 45 din ke andar payment karna hai (agar kuch tay nahi hua to 15 din). Deri par RBI bank rate ka teen guna byaaj, monthly compound. Claim MSME Samadhaan portal par, aapke apne state ki Facilitation Council mein, 90 din ka target; buyer ko appeal ke liye award ka 75% deposit karna padta hai.
  • Section 138, NI Act: Cheque bounce hone par bank ke return memo ke 30 din ke andar notice, 15 din payment ke liye, phir 1 mahine ke andar complaint. Saza 2 saal tak ki jail ya cheque amount ka do guna fine, ya dono.
  • Limitation Act: Paise ka claim 3 saal ke andar file karna hota hai; buyer ka likhit acknowledgement ya part payment 3 saal phir se shuru kar deta hai.

Byaaj ka hisaab MSME interest calculator par aur cheque ki deadlines cheque bounce timeline par dekhein.

Call se pehle kya check karein

  • Invoice ki date, due date aur credit period (likhit ya samjha hua)
  • Delivery ka proof: signed challan, e-way bill, LR ya service complete hone ka email
  • Buyer ne kabhi likhit mein (WhatsApp par bhi) paisa maana hai?
  • Udyam certificate hai ya nahi
  • Koi cheque diya gaya aur bounce hua? Return memo ki date?

Sab kuch zaroori nahi hai; jo nahi hai, expert puchh lega. Lekin jitna ready hoga, assessment utna sahi hoga.

Consultation ke baad kya hota hai

Agar aap aage badhna chahte hain, to documents WhatsApp ya email par share karte hain aur ek chhota engagement sign hota hai. 24 ghante ke andar dedicated advocate assign hota hai aur legal notice e-notice ke roop mein, phir registered post se jaata hai. Zyada tar buyers notice period mein hi respond karte hain; advocate payment ya schedule negotiate karta hai, aur 60% cases yahin close ho jaate hain.

Agar buyer phir bhi nahi deta, to wahi advocate sahi proceeding file karta hai: MSME Samadhaan, Section 138 complaint, summary suit ya arbitration. Upfront kuch nahi; 30% sirf recovered amount par; court fees, agar file hua, aap dete hain aur pehle bata di jaati hai. Recovery fee calculator par dekhein ki kitna aapke paas rehta hai.

Agar aap aage nahi badhna chahte, to kuch bhi dena nahi hai aur buyer ko kuch bhi nahi bheja jaata. Consultation har tarah se free hai.
