What a debt recovery lawyer looks for
- Cause of action and limitation: when the debt fell due and whether three years have passed since then or since the last written acknowledgement
- Documents that prove the contract and performance: PO, invoice, delivery or completion proof, acceptance
- Statutory hooks: Udyam registration (MSMED Act), a bounced cheque (Section 138), an arbitration clause
- The defendant: correct legal entity, registered office, jurisdiction, assets
- Defences the buyer might raise: quality, short supply, set-off, or that goods were on approval
You will be asked about each of these. Having the answers ready makes the consultation sharper.
What you are told at the end
Whether there is a claim; which route the advocate would take and why; the expected timeline for the notice stage and for filing if needed; which court or Council has jurisdiction; and the cost. Engaging the advocate
If you decide to go ahead, a dedicated advocate is assigned within 24 hours of your complete documents and the legal notice goes out as an e-notice, followed by registered post. The same advocate handles negotiation and, if required, the filing: MSME Samadhaan before the state Facilitation Council, a Section 138 complaint before the magistrate, a summary suit in the civil or commercial court, or arbitration.
