MSE Facilitation Councils in India: state-wise reference

Under Section 20 of the MSMED Act, every state constitutes one or more Micro and Small Enterprises Facilitation Councils. They hear delayed-payment claims filed on MSME Samadhaan by suppliers located in that state. This page lists the Councils FundRaksha works with, and links to each state’s detail page.

Short answer

An MSME Samadhaan claim is filed with the Facilitation Council of the state where the supplier is located, not the buyer. The Council first attempts conciliation; if that fails it arbitrates and passes an award that is enforceable like a court decree. Councils must aim to decide within 90 days of the reference.

Council addresses and sitting schedules change; the current contact for each Council is published on samadhaan.msme.gov.in when you file. FundRaksha’s advocates file and appear before every Council listed.

How a reference is heard

  1. The supplier files the application online with invoices, proof of delivery and the Udyam certificate.
  2. The Council issues notice to the buyer and calls both sides for conciliation (Sections 65 to 81 of the Arbitration and Conciliation Act apply).
  3. If conciliation fails within the period the Council allows, the dispute goes to arbitration by the Council or an institution it refers it to.
  4. The award is passed with principal and interest; it is enforced through the civil court like a decree.
  5. A buyer who wants to challenge the award under Section 34 must first deposit 75% of the awarded amount.

Who can file

Micro and small enterprises registered on Udyam that supplied goods or services, where the buyer has not paid within the agreed period or 45 days from acceptance, whichever is earlier. Medium enterprises and pure traders are generally outside the delayed-payment provisions. FundRaksha checks eligibility in the free consultation before filing; our model is 30% only on recovery.
