Maharashtra Micro and Small Enterprises Facilitation Council

Maharashtra has more registered MSMEs than any other state and runs regional Facilitation Councils rather than one, so a Pune supplier’s claim is heard in the Pune region and a Nagpur supplier’s in Vidarbha. Mumbai’s corporate contracts frequently carry arbitration clauses that decide where a dispute goes. This page explains how a Maharashtra micro or small supplier takes a delayed-payment claim to the Council.

Short answer

A Udyam-registered micro or small enterprise located in Maharashtra files its delayed-payment claim on MSME Samadhaan; it is heard by the Maharashtra Micro and Small Enterprises Facilitation Councils (regional councils for Mumbai, Pune, Nashik, Nagpur, Aurangabad and Amravati regions), run from the Directorate of Industries, Government of Maharashtra, Mumbai, and regional Joint Director of Industries offices. The Council conciliates first, then arbitrates, aiming to decide within 90 days, and awards interest at three times the RBI bank rate.

Filing from Maharashtra

  1. Confirm Udyam registration and that the supply was made after registration.
  2. Compute the due date (agreed date, at most 45 days from acceptance; 15 days if nothing was agreed) and the interest to date.
  3. Send a legal notice citing Sections 15 and 16 of the MSMED Act; many buyers settle here.
  4. File on samadhaan.msme.gov.in with invoices, proof of delivery, ledger and the notice.
  5. The Maharashtra Micro and Small Enterprises Facilitation Councils (regional councils for Mumbai, Pune, Nashik, Nagpur, Aurangabad and Amravati regions) issues notice to the buyer, holds conciliation, then arbitration.
  6. The award is enforced as a decree through the civil court; a buyer who appeals must deposit 75% first.

Industries that use the Maharashtra Council most

Suppliers in auto and engineering, textiles, pharma and chemicals, IT and services, sugar and agri-processing account for most delayed-payment references from Maharashtra. Buyers may be anywhere in India; jurisdiction follows the supplier.

Costs and timeline

Filing on MSME Samadhaan has no court fee. The Act asks the Council to decide within 90 days of the reference; in practice the timeline depends on the Council’s calendar and the buyer’s conduct.
