Short answer

File a Section 138 complaint before the Metropolitan or Judicial Magistrate having jurisdiction over the branch of the bank where you (the payee) maintain the account into which the cheque was deposited (Section 142(2)(a)). The timeline is strict: notice within 30 days of the return memo, 15 days for the drawer to pay, complaint within one month after that.
