Short answer

Written agreement na hone ka matlab ye nahi ki contract nahi hai. Aapka invoice, buyer ka GST ITC claim, bank me pehle ke payments, e-way bill aur WhatsApp chat milkar order, rate aur delivery saabit karte hain. Pehla kaam: buyer se ledger balance confirm karwayein. Fir legal notice bhejein. Micro ya small supplier ke liye written agreement na ho to 15 din ki payment limit lagti hai.

Bina agreement ke contract kaise saabit hota hai

Court dekhta hai ki dono party ke beech kya chal raha tha. Agar aap saalon se maal bhej rahe hain aur buyer pay karta aaya hai, to ye ek chalta hua contract hai. Ye cheezein jodein:

  • Aapke GST invoices aur GSTR-1 filing
  • Aapki GSTR-1 filing, jisse aapka invoice buyer ki GSTR-2B me dikhta hai aur wo uspar ITC leta hai
  • Bank statement me buyer se aaye pichle payments
  • E-way bill, LR, challan
  • Phone call ke baad bheja gaya WhatsApp ya email

Ab sabse zaroori kaam: written acknowledgement

Abhi tak likha padhi nahi thi, to ab banaiye. Buyer ko ek simple ledger statement bhejein aur kahein "kripya balance confirm kar dein". Agar wo reply karta hai "haan, itna baaki hai" ya "jaldi bhejenge", to ye written acknowledgement hai. Isse:

  • Debt saabit ho jaata hai
  • Limitation ki 3 saal ki ghadi dobara shuru hoti hai
  • Baad me "maal mila nahi" ka bahana khatam

Is stage par dhamki ya gussa na dikhaayein. Normal hisaab ki tarah baat karein, taaki buyer bina soche confirm kar de.

Legal notice aur raste
