The claim goes to the Facilitation Council of the supplier's state, which conciliates and, failing that, arbitrates, with a target of 90 days. The award carries interest at three times the RBI bank rate, and a buyer must deposit 75% of it to appeal. How the process runs
- Application filed online with Udyam details, buyer details, invoices and proof of delivery or acceptance.
- The reference goes to your state's Facilitation Council (see the state pages for each Council).
- The Council first conducts conciliation. Many buyers settle here, because the interest keeps running.
- If conciliation fails, the Council arbitrates itself or refers to an institution, and issues an award.
- The award is enforced as an arbitral award. A buyer wishing to challenge it must deposit 75% first.
The 90-day target is not always met; the expert will give you a realistic view for your state's Council.
Why file through an advocate
The portal is open to anyone, but the claim's strength depends on how the appointed day is established, how the statement of account is presented, and how the buyer's objections are answered at conciliation and arbitration.
