Arbitration or court?

Many commercial contracts carry an arbitration clause. If yours does, disputes go to an arbitral tribunal rather than court; the award is enforceable like a decree and the process is usually faster. If there is no clause, a summary suit under Order XXXVII CPC fits fixed sums, and an ordinary civil suit covers damages.
